Terms and conditions

The following terms and conditions will apply to all occupants [you, your] who stay at our property managed by Allen Barr trading as Crystal Creek Railway Cottage, 26 Trotter Road, Mutarnee, North Queensland, 4816 (We, Us ,Our). We act as the property manager for the property. We only accept bookings on the terms and conditions outlined in this document. It is your responsibility to have read and understood the terms and conditions before making a booking. You must ensure you, and all visitors, comply with these terms, conditions, house rules relating to the property, and any by-laws (where applicable). A breach of these terms and conditions by any occupant, guest or visitor will be considered a breach by you. Failure to comply with these terms and conditions may result in, but is not limited to, you being evicted from the property, and losing your monies paid by you.

Information about the property

Accuracy.

We endeavor to ensure the information about the property is current and accurate on our website, however this information may change without notice. The description of the property is made in good faith. We accept no responsibility for errors or emissions. All photos on our website are taken on site, are provided as an accurate representation of the described property at the time the photograph was taken and are subject to change with fair wear and tear, refurbishing and other circumstances outside our control. We do not accept responsibility for personnel perceptions. If any feature, facility or any other consideration is essential for your choice of a particular part of the property, you should confirm this with us at time of booking. We cannot be held liable for omissions or errors, whether temporary or permanent regarding the property’s facilities, services features and benefits.

Facilities.

The property under our management is privately owned and rented on a fully self-contained basis unless otherwise agreed. In the event of faults and/or malfunctions of appliances or inclusions, there is no obligation from the owner to compensate or discount, however, we endeavor to be fair and ethical and will review on a case-by-case basis. We accept no responsibility for any inconvenience with machinery or appliance breakdown and/or missing parts. However, in such circumstances, we will undertake our best endeavor to repair, replace or hire an alternative where possible and reasonable.

Reservations and payments.

All pricing is in Australian dollars (AUD) and inclusive of GST, where applicable. Bookings at the rate quoted are not guaranteed until a booking is paid in full and successfully processed by us.

We will accept payments by Visa, MasterCard, American Express or direct deposit via our website. We are unable to accept payments by cheque, digital currency (cryptocurrency) or cash (in person). We are not responsible for any settlement delays, transaction fees, foreign exchange fluctuations, bank/payment provider fees or charges. We are unable to provide access to the property until we have received the total booking cost by the due dates on the payment schedule at the time a booking is confirmed. Total booking cost means the total rate of amount payable for the full period of your stay.  We reserve the right to change payment terms and dates at any time.

Availability.

We will make every effort to ensure the property booked is available for the dates agreed. However, we reserve the right to make alterations to the booking due to unforeseen circumstances including, but not limited to, “Acts of God” or emergency repairs. We will provide you with written notice if a booking becomes unavailable, however, we will refund the monies paid for the whole or part of the booking not fulfilled. The owner reserves the right to cancel a booking at any time.

Cancellations.

Cancellations must be notified in writing. If you cancel within 48 hours of your booking request and your check in date is 30 days or more in advance, you will receive a refund of the monies paid. If you cancel within 48 hours of booking and your check in is less than 30 days away, the entire monies paid is non-refundable. If you cancel on the day of check in or any time before check out, there is no refund.

Terms of stay.

Property access. Full payment must be received before access to the property will be provided. If full payment is not received by payment date, we reserve the right to cancel the booking and may re-book without notice.

Inspections, repairs and maintenance.

The owner reserve the right to conduct inspections, repairs or general maintenance while the guest occupies the property, with reasonable notice. If access is required, the owner or any contractors, will respect your privacy and will do everything possible to minimise any disruption or inconvenience. In the event of an emergency, where a tradesperson is already on the property, these will be permitted immediate access to the property without prior notice or announcement. An emergency is defined as a situation that presents immediate threat to the property or health and safety of individuals on the premises. The term ‘tradesperson’ shall refer to any individual or company contracted by the owner to perform repairs or maintenance on the property.

Occupants.

The names, number of people and ages provided at the time of the booking must be accurate for the guests who will occupy the property. There is no additional charge for infants under 2 years of age.

Check in/ check out times.

Check in is after 2 pm and check out is 10 am. Please contact us two days before arrival/departure if you would like to request an early check in or late check out. We are unable to guarantee early or late check in/outs in any circumstances unless the guest has booked and paid for additional nights to accommodate this. All early/late checkouts must be confirmed in writing by us and noted within our booking system. Under no circumstances should the guests access the property before the agreed check in time or remain/access after the agreed check out time without explicit written permission from the owner. Any unauthorised access or extended stay will be considered a breach of these terms and may result in additional charges, or immediate removal from the property.

Security.

It is your responsibility to maintain the security of the property. You will be held responsible for any incident that occurs during your stay or upon departure as a result of the premises being left unsecured. Properties have external security cameras or smart doorbells monitoring public spaces for security purposes. Cameras may be used to verify compliance with rental policies and should not be relied upon by guests for personal security.

Garbage.

Garbage disposal and waste minimisation is your responsibility. Excess rubbish must not be left at the property or surrounding areas, neighbours properties, public or common areas. You must dispose of all garbage appropriately within designated bins outside the property, including recycling bins as labelled.

Cleaning.

If the property is not cleaned to an acceptable standard for your arrival, you should advise us within 2 hours of your arrival, and the issue will be resolved within 24 hours of being notified or as agreed. During your stay, and with 24 hours’ notice, you may request additional cleaning and linen changes.  You may be charged additional or excess cleaning fees on departure.

Access and parking.

The maximum number of vehicles permitted onsite in the designated parking space will be confirmed by us. Parking in or across driveways, on common grounds, footpaths, in restricted parking areas and/or non-designated parking spaces is forbidden and may result in fines and/or towing at your expense.

Internet.

We are not responsible if internet access is restricted or unavailable. We are not responsible for mechanical failure, breakdown or failure of your equipment to connect with the wireless connection provided.

Appliances, BBQs and fireplaces.

Please make sure that the barbeque, oven and firepit, where applicable, are left clean. Failure to do so may result in additional cleaning charge for each appliance.

Mail.

We are not responsible for any mail or items delivered to the property. It is strongly advised that you arrange a local postal box or alternative mail delivery arrangement

Pets.

Pets are not permitted at anytime in the property unless explicitly agreed by us in writing before arrival. Welcoming any pets into the property without written permission will require the property to be fumigated and cleaned for health and safety reasons. You will be solely responsible for the property management labour required, as well as all the costs associated with the repair or replacement of any damage related to an animal.

Smoking and vaping.

The property is strictly non-smoking/non-vaping unless otherwise agreed by us in writing before arrival. Additional charges may apply if smoking/vaping has occurred inside the property. Smokers/vapers may smoke/vape outside the property. Smoking and/or vaping can be offensive, is a fire hazard and is harmful to the health of others.

Noise, disturbances, parties, events and functions.

Please respect the property’s neighbours by keeping noise to a reasonable level at all times, particularly between 10pm and 8 am, and refrain from engaging in any drunken, obscene or antisocial behaviour. You must abide by any noise abatement order issued by the police or any regulatory authority. Private events, parties, functions and weddings are strictly prohibited without explicit advance written permission.

Travel insurance.

Guests should consider their need to buy travel insurance to cover cancellation costs, medical expenses, personnel belongs and other travel related expenses during their stay. Guests should read the terms and conditions of their travel insurance policy and credit card agreement to understand the coverage.

Damage, theft, loss and risk.

You have a duty of care to use the property and its contents as intended for everyday usage and return it in the same condition as your arrival. You are not authorised to move any furniture or furnishings or use the property for storage, unless agreed in writing. Any damage (including breakage) theft, loss of expenses caused by an act or omission is exclusively your responsibility during your stay. You will be responsible for damage, replacement and/or repair to all contents, fixtures or fittings of the property, common property and/or neighbouring properties caused by your negligence, lack of duty of care , or omission, but not attributable to fair wear and tear. You are also responsible for damage, loss or expenses caused by all registered occupants, your guests and other people invited into the property. If during your occupancy, due to accident, negligence, improper usage or willful acts of you or your guests, the property and its contents requires repairs, replacement or restoration to its original condition, these costs will need to be paid. This includes, but is not limited to, expenses incurred for repairs or labour fees attributable to improper usage. You may also be responsible for additional accommodation fees if the property is unable to be booked by another guest following such damage. Any damage over AUD $500 including GST may  result  in a report lodged with the police as malicious damage. Fair wear and tear mean the deterioration that occurs over time with everyday use of the premises, even though the premises receives reasonable care and maintenance. Negligence is defined as failure to give care or attention especially when could cause foreseeable damage or harm. If you identify any risk associated with the property, you are to advise the owner immediately and the owner will endeavor to have the issue addressed and resolved as quickly as possible.

Health and safety.

To promote and protect the health and well being of others, all guests are responsible and have the duty of care to notify us in writing of any special needs, health conditions or reasonable risks associated with having contracted (or have a high probability of having contracted) an infectious/contagious disease , which may impact your stay or suitability of the property for your booking. This includes, but is not limited to allergies, pre-existing medical conditions and any mobility issues. The owner is committed to providing a healthy environment and to taking reasonable and appropriate steps to prevent or minimise the health and safety risks of all guests, owner and tradespeople and anyone else who may visit the property. The owner cannot be held accountable for your failure to disclose specific health and safety information, which may result in an inability to accommodate these needs causing a loss of enjoyment, relocation or cancellation costs. The Work Health and Safety Act 2011 requires all persons conducting a business or undertaking to ensure the health and safety of its workers, so far as is reasonably practical by eliminating risks to health and safety. Guests owe a similar duty of care to other people who may be at risk from work carried out by the business. The act also confers a responsibility on employees to act with regard for the health and safety of any person in the workplace and to comply with workplace requirements imposed by health and safety legislation. Importantly, all notifications will be treated with the highest degree of confidentiality and will adhere to privacy policy.

Subletting.

If it is discovered that you are subletting the booked property without disclosure or permission, this will be deemed a breach of contract, and the booking will be terminated with immediate effect. No monies will be refunded for any dates left on the booking.

Indemnity.

The owner is not liable and takes no responsibility in any way for guests’ personal property or injury that may occur to you or others while occupying the property. The guests shall hold the owner harmless and indemnified against all loss, injury or damage occasioned by the use, misuse or abuse of any part of the property and from or against any omission, neglect or default of the guests (or others), licensees or invites.

Commercial use.

You are authorised to occupy the property for domestic, private use only, unless otherwise agreed by us in writing at the time of booking.

Disputes and complaint resolution.

All complaints should be addressed to us in writing, and we will endeavor to settle the problem by mutual agreement between all parties within 48 hours or as otherwise agreed.

Communication.

The owner will not be held responsible for answering phone calls/ emails outside of work hours displayed on our website and on public holidays. We endeavor to respond to calls/emails as quickly as reasonably possible.

Confidentiality.

This agreement is strictly confidential and must not be shared with others not associated with this agreement, including neighbours of the property.

Variations.

Variation to these terms and conditions may only be made and must be agreed to by both parties, before any monies are paid with us in writing. We reserve the right to change part of these terms and conditions at any time, without notice and other communication. It is your responsibility to keep yourself updated on any changes to these terms and conditions. If you object to a change of the terms and conditions after paying us monies, it is your responsibility to advise us immediately, and we both agree to negotiate reasonably to produce an outcome acceptable to both parties. Any such negotiations must take place before you occupy the property.

Reviews.

We reserve the right replicate, publish and/or distribute any written feedback that has been provided by a prospect, guest, owner or any other stakeholder at any time. In doing so, we commit to adhering to our privacy policy. when a review is published, we endeavor to do so in such a manner that does not identify the full name of the person providing feedback (i.e. full given name and surname).

Effective date.

These terms and conditions were last updated on 6 May 2026. They may be changed from time to time, without notice on our website. In case of any variation of booking conditions between us and an independent third party booking provider or agent, the terms posted on our website will apply.
